Validity:
if any part of these terms and conditions are deemed to by unenforceable, void or invalid they will be considered severable from these terms and conditions. The remainder of these terms and conditions will however still be considered valid.

You, the customer, promise that you are at least 18 years of age and have the legal right to enter into this agreement with us. You further promise to provide us with details to check the validity of any debit and or credit transactions and that all of the information supplied to us is true. By clicking the ‘Place Order’ button you are confirming your commitment to pay for all items in your basket at checkout , including shipping costs.

Refusal:
we reserve the right to refuse any order or transaction without giving notice and for whatever reason, whether or not monies have been paid. The placing of an order does not establish a contract between you, the customer, and us, the company. A contract is deemed to exist once goods have been despatched to you.

Governing law:
the use of this website, products supplied through it and purchases are governed by English law and deemed to have occurred in mainland United Kingdom. The courts of England and Wales will have exclusive jurisdiction to hear and deal with any proceedings.

Payments

We accept payment in one of the following ways:
By credit/debit card via our secure one page checkout facility with our service providers
Paypal or Sagepay. Credit card details are not held by the company.
By Paypal using your Paypal account.
Payment is also accepted by credit or debit card over the telephone.
By BACS transfer; please contact us for details.
All prices quoted are inclusive of VAT at 20 per cent. (VAT No. GB. 919 6224 09).

For overseas transactions the card services provider will use the current conversion rate and convert the Pounds to your currency.

Shipping And Handling

Shipping and despatch:
We aim to dispatch all orders within 2 working days although some may take longer. If your order is going to be significantly delayed we will let you know. Please provide the date of the celebration when placing your order; at peak times orders may be prioritised according to when they are required and not the order in which they are received.

We will arrange delivery of your goods using the most suitable method to the address you enter when you place your order. Please ensure that this address is correct. If goods are returned to us because a) you have entered an incorrect address; or b) you have failed to collect goods from a sorting office; or c) not responded to cards left by our courier we reserve the right to charge you for re-delivery.

Mainland England, Scotland (excluding Highlands and Islands) and Wales.

Standard delivery charge is from £3.50 using Royal Mail 48 service. – 3 – 5 delivery service or a courier service for heavier items. Stated delivery times are from date of despatche NOT date of order and are not guaranteed. Delivery times are estimated and based upon data provided by Royal Mail and the courier company. Our company is not responsible for any delay, or subsequent loss, caused by late delivery of parcels sent using these services.

We are open Monday – Friday, but may be closed on Bank holidays. If you need an order urgently please contact us.

A next day guaranteed delivery service is available on most items, please ask for details or select the next day delivery option. There is a charge of £10.50 for this service (mainland UK only). This is a next working day delivery service and excludes Saturday and Bank Holiday deliveries. Saturday deliveries can be selected at a premium rate of £25.20, (based on courier cost). Personalised and ready made items may take up 5 days to process, next day delivery is not available on almost all personalised items due to the processes involved, please contact us for details. If you select next day shipping on these items your order will be shipped on a next day delivery basis once it is complete. Additional charges apply for Highlands and Island districts, including Northern Ireland and the Channel Islands due to increased courier charges to these areas; this will be shown at checkout.

Highlands and Islands including Northern Ireland and the Channel Islands: £24.50 for all parcels over 1.5kg. Please note if you select standard UK delivery at checkout the company reserves the right to charge you the additional delivery cost if necessary. We will contact you if this is the case and give you the option to either pay the increased charge or to cancel the order.

European shipments

We ship internationally to Europe. Postal charges to Europe are from £26.50 depending on country and delivery option. Deliveries over 1.5kg to Europe may be subject to a shipping surcharge. We will notify you and get agreement before shipment.Please contact us for any special requirements or light weight orders.

We do not deliver to PO Box addresses.

The company is not responsible for any subsequent loss caused by late delivery of parcels sent using any of these services.

Chocolate Shipments:
Please ensure you provide a delivery address where someone is available to accept delivery. We are happy to deliver to an alternative address if you are out all day.

Chocolate orders of more than 1.5kg in weight will not be despatched on Fridays unless we are asked to do so. In these circumstances shipment is at the customers own risk and we accept no responsibility if the chocolates are damaged by temperature fluctuations whilst the goods are in transit.

Event Date:

When you place your order we will ask you to let us know the date of the event the goods are required for. This date is used for internal processing of your order and does not infer or imply that your order will reach you on or before that date unless you have chosen to use a guaranteed delivery service. If you choose our standard delivery service you acknowledge your acceptance and understanding that this service is not guaranteed and the company has no control of the date your goods will actually be delivered.

Returns & Cancellations Policy

Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm. From the 13th June 2014 your rights are protected under The Directive on Consumer Rights (2011/83/EC)

If you change your mind about your purchase goods may be returned to us – subject to the restrictions below – providing you notify us, by telephone and/or in writing within 14 days of their receipt. Goods may not be returned without prior authorisation. Goods must be returned to us in the original packaging and in a suitable condition for resale. The company reserves the right to charge for any product which is returned in an unsatisfactory condition up to 100% of the product cost. The goods remain the responsibility of the customer until they are received by us – customers are advised to return all goods using a recorded delivery method. The company does not refund the cost of returning products to us or the original shipping charge in these circumstances.

Please note that no refunds can be given on the following items:

Any goods made to the customers own specifications. hand-made items, personalised items, and jewellery or food, including sweets and chocolates, unless they are found to be faulty or not as described. Customers ordering personalised items must ensure that the details they give to the company are correct – refunds will not be given if it is later found that the personalisation is incorrect unless it is the fault of Favour Fairy. Please note that special characters may not be replicated on some personalised items and we recommend that you avoid using them.
Damaged goods: in the event that any part of your order is damaged or missing please notify us within 14 days either by email or telephone and we will arrange for replacements to be sent to you. We do not accept liability for additional losses as a result of a fault.
We may ask you to return damaged items to us. In this event we will gladly refund any reasonable postage charges you may incur.

The company does not refund the cost of returning products to us, this is the responsibility of the customer. Please obtain a receipt or proof of posting from the post office as this will be needed if goods are lost in transit. Refunds will be given on the following basis: Full refund of product cost providing goods are returned in a suitable condition for resale together with a refund for our standard shipping charge. Refunds will be made within 14 days of receipt of the goods. If you wish you may use the return form which you can download here

Cancellations

You have the right to cancel your order subject to the following:

If goods have already been despatched we are unable to accept any cancellations until goods are returned to us

Orders of personalised items and items made to customers specifications may not be cancelled once the order has started to be processed whether or not the goods have been despatched.

Back Orders
If your item is not available we will notify you. Depending on the date of your event you may choose to wait whilst we secure supply if the item is out of stock. Of course we will understand if you cannot wait and cancel.

Colours:
Variations in screen settings and photographic equipment means that colours seen on your screen can also be misleading. We are therefore unable to guarantee that colours on screen will exactly match any products supplied. We will not accept returns of stock in these circumstances.

Complaints:

We are only human and from time to time things do go wrong. If we have made a mistake and you would like to make a complaint in the first instance please contact the company via email to contact@favourfairy.co.uk. We will investigate and get back to you within 5 working days.

Customers are also reminded that under EU legislation they may also use the EU Online Dispute Resolution Platform. 

Privacy Policy

The company does not disclose buyers’ information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.
Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the ‘Remember Me’ Option. They are also used after you have logged on as part of that process. You can turn off cookies within your browser by going to ‘Tools | Internet Options | Privacy’ and selecting to block cookies. If you turn off cookies, you will be unable to place orders or benefit from the other features that use cookies. Data collected by this site is used to:
a. Take and fulfil customer orders
b. Administer and enhance the site and service
c. Disclose information to third-parties for goods delivery purposes and to enhance user experience e.g Feefo

Charitable donations:
Please send requests for charitable donations to contact@favourfairy.co.uk but kindly note the following.:
We support UK charities only – a charities number is required.
Donations will only be made directly to the charity concerned – we do not support individuals organising events ‘in support of’..
Any or all donations are at the discretion of the owners. Please do not be offended if your request for support meets with a refusal – we get a lot of requests and it is simply not possible to support everyone.

Confectionery
supplied may contain nuts or may have been produced in an area in which nuts have been processed. A full ingredients list will be provided with all confectionery products.

Stock Availability

we endeavour to keep sufficient stock to cover all orders however from time to time an item may be out of stock even if this is not shown on the website. If an item you have ordered should be out of stock we will contact as soon as possible to let you know when , or if, the item will become available again.

Discounts and pricing:
we reserve the right to change our pricing and withdraw any discounts without notice.

Sample requests:

Please request a sample from us using the contact form from our site. Please note that we reserve the right to refuse any request for a free sample at any time and we do not guarantee to supply any or all of your request. Personalised items, favour gifts such as fans, bar ware and key rings will not be supplied. A maximum of 2 chocolates will be supplied per request. You must accept our terms and conditions and complete all details when submitting your request. One request per household, no more than 3 samples per request.
